By accessing or using the Hubdustry Discord bot ("Bot") and web dashboard ("Dashboard") at hubdustry.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Service

Hubdustry provides a Discord bot and web dashboard for managing Discord servers. Our services include:

  • Server Management — Channel management, role management, server settings
  • Moderation — Auto-moderation, manual moderation tools, audit logging
  • Leveling System — XP tracking, level roles, rank cards, leaderboards
  • Music Playback — Music streaming in voice channels
  • Custom Flows — Automated workflows triggered by Discord events
  • Embed Builder — Visual Discord embed creation and management
  • Translation — Real-time message translation
  • VoiceMaster — Temporary voice channel management
  • Web Dashboard — Browser-based server configuration interface

3. Account Registration

To use the Dashboard, you must authenticate via Discord OAuth2. By logging in, you:

  • Authorize us to access your Discord account information as specified in our Privacy Policy
  • Are responsible for maintaining the security of your Discord account
  • Are responsible for all activities that occur under your account
  • Must be at least 13 years old (or the minimum age required by your local laws)

You must not share your account access or use another person's account without their permission.

4. Subscriptions and Billing

Free Tier

Basic bot features are available at no cost.

Premium Plans

  • Premium subscriptions provide additional features and higher limits
  • Subscription fees are billed through Stripe on a recurring basis
  • Prices are listed on our Pricing page and may change with 30 days notice
  • All fees are in USD unless otherwise stated

Auto-Renewal

  • Subscriptions automatically renew at the end of each billing period
  • You may cancel at any time before the next billing date
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds are provided for unused portions of a billing period

Refunds

Refunds may be considered on a case-by-case basis within 7 days of purchase. Contact us to request a refund.

5. Acceptable Use

You agree not to use our services to:

  • Violate Discord's Terms of Service or Community Guidelines
  • Violate any applicable local, national, or international law
  • Harass, abuse, threaten, or harm other users
  • Send spam, unsolicited messages, or engage in phishing
  • Attempt to gain unauthorized access to our systems or other users' data
  • Exploit bugs or vulnerabilities instead of reporting them
  • Use automated tools to abuse our API or services
  • Circumvent rate limits or usage restrictions
  • Impersonate Hubdustry staff or representatives
  • Use the service for any illegal or fraudulent activity

We reserve the right to suspend or terminate your access for violations of these terms.

6. Intellectual Property

Our Property

The Hubdustry bot, dashboard, website, branding, logos, documentation, and all related code are the intellectual property of Hubdustry. You may not:

  • Copy, modify, or distribute our software
  • Reverse engineer, decompile, or disassemble any part of our services
  • Use our branding or trademarks without written permission
  • Create derivative works based on our services

Open Source

Certain components may be released under open-source licenses. Those components are governed by their respective licenses.

7. User Content

Ownership

You retain ownership of all content you create through our services, including:

  • Server configurations and settings
  • Custom embeds and messages
  • Flow/workflow definitions
  • Moderation rules and settings

License Grant

By using our services, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing our services. This license terminates when you remove your content or stop using our services.

Content Responsibility

You are solely responsible for your content and its compliance with applicable laws and Discord's policies.

8. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service
  • Services are provided on a "best effort" basis
  • We may perform scheduled maintenance with reasonable advance notice
  • Unscheduled downtime may occur due to technical issues, security incidents, or force majeure
  • We are not liable for any losses resulting from service downtime

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not responsible for actions taken by Discord or third-party services that affect our bot's operation

10. Indemnification

You agree to defend, indemnify, and hold harmless Hubdustry and its operator from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or distribute through our services

11. Termination

By You

  • You may stop using our services at any time
  • You may remove the bot from your servers at any time
  • You may request account deletion by contacting us

By Us

We may suspend or terminate your access if:

  • You violate these Terms
  • Your use poses a security risk
  • Required by law or legal process
  • We discontinue the service (with reasonable notice)

After Termination

  • Your right to use our services ceases immediately
  • Associated data will be deleted within 30 days, unless legally required to retain
  • Sections that by their nature should survive termination will survive (including Limitation of Liability, Indemnification, and Governing Law)

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Japan.

13. Changes to These Terms

We may modify these Terms at any time. When we make material changes:

  • We will update the "Last Updated" date at the top of this page
  • We will provide at least 30 days notice before material changes take effect
  • Continued use of our services after changes take effect constitutes acceptance of the revised Terms

If you disagree with the changes, you should stop using our services before the changes take effect.
